As our parents and grandparents age, we are often faced with questions didn’t foresee, such as Who takes care of Grandma? Who manages Dad’s affairs? What about the house? Who pays the bills?  Infirmity can creep up on us, or it can come out of nowhere, but regardless it is never easy making the decision to move a loved one into a facility and emotions run high.  

If your loved one has no healthcare directive or living will in place, an immediate family member needs to be appointed as a guardian.  Families can come together to mediate answers to the questions of what care needs to be provided when, how to manage finances, how to handle property, and when to liquidate assets. Who will be appointed guardian is often a divisive issue in families, especially with complex estates involving land, businesses, or considerable assets.  Courts typically award all-or-nothing guardianship based on who the judge feels is best suited to the role and makes the best argument.  If you mediate an agreement, you can set the ground rules for who does what, when.

Once a family member has passed away, we’re faced with a mountain of decisions and an ocean of intense emotions.  Sometimes wills aren’t very clear.  Sometimes there is a question of accuracy and intent.  Sometimes there isn’t even a will to refer to.  Instead of spending thousands of dollars litigating estate matters, and potentially ripping your family apart in the process, you can mediate or arbitrate your issues on your own.

If you mediate an agreement, you control your future and make all the decisions for yourselves.  If you don’t, a judge or arbitrator will make the decision for you and you leave your future in the hands of a stranger.
